ABSTRACT

In this paper, the authors shows that the right to effective access to a court represents one of the most important components of the institutional and legal framework within democratic states around the world. It shapes, strengthens, and guarantees the observance of individuals’ right to a fair trial and to the realization of their specific legal interests, within a just and predictable normative framework enforced by judicial bodies.
