ABSTRACT

This article introduces the Arbitration Act 2025 and examines the key amendments introduced by it, which aim to modernise and enhance the arbitration process in England and Wales. It discusses the most significant changes such as the choice of applicable substantive law for arbitration agreements, the codification of arbitrators' duty of disclosure, and the introduction of summary dismissal powers, while also highlighting some arguably notable omissions.
